These Terms of Service govern website packages and services purchased through Poinky. By purchasing a Poinky website package, you agree to these terms. Our goal is straightforward: deliver professional websites that help your business grow, with clear expectations on both sides.

Poinky offers three productized website packages: Launch, Professional, and Business+. Each package includes specific features, a defined number of revision rounds, and 12 months of Poinky SiteCare. Package details are described on the website at the time of purchase.
Each package includes the features listed on the package at the time of purchase. Additional pages, custom functionality, or work outside the included package scope may require an additional fee. Poinky will always discuss and receive your approval before performing any additional billable work. You will never receive a surprise charge.
Launch includes 1 revision round. Professional includes 2 revision rounds. Business+ includes 3 revision rounds. A revision round is one consolidated set of reasonable feedback and requested changes after reviewing your website.
You can submit multiple text, image, layout, or content changes together as a single revision round — a revision round does not mean only one individual edit. Additional revision rounds beyond what is included in your package may be available for an additional fee.
Website project cancellation and refunds are governed by the Poinky Satisfaction Promise. See the full Satisfaction Promise for details about refunds before work begins, during production, project setup fees, and after final approval.
Poinky may need additional information after purchase to complete your website. This may include business details, domain information, logos, photos, service descriptions, team information, branding preferences, account access, integration details, and other information reasonably needed to complete the project.
You are responsible for providing reasonably requested information and approvals needed to complete your project. You don't need everything figured out before you buy — Poinky will walk you through what's needed.
Poinky may request secure access to your domain registrar, hosting account, existing website, or other services when needed to complete your project. Where supported, Poinky prefers delegated access, user invitations, or secure credential-sharing methods over asking you to send passwords directly.
Do not send passwords through normal email or chat unless specifically instructed to use a secure method.
Your project timeline begins once Poinky has the information and access needed to get started. If Poinky is waiting on content, approvals, or account access, your delivery timeline may adjust accordingly. Any advertised turnaround time applies to active project time, not time spent waiting for required customer information.
If Poinky is waiting for required information, content, access, feedback, or approval, your project may be paused. Your delivery timeline pauses while Poinky is waiting. After an extended period of inactivity (90 days) and reasonable attempts to contact you, Poinky may classify the project as inactive.
Inactive projects can be reactivated by contacting Poinky. Poinky will not automatically forfeit your payment simply because of inactivity, but projects inactive for more than 180 days may require a review to determine if the original scope and pricing still apply.
You are responsible for having the necessary rights or permission to use materials you provide to Poinky. This includes logos, photographs, videos, trademarks, written content, graphics, testimonials, and other customer-provided materials. Poinky is not responsible for copyright or ownership issues involving materials supplied by you.
You are responsible for reviewing business-specific information before final approval. This includes your business name, phone number, email, address, service areas, services, pricing, claims, licensing information, policies, hours, professional credentials, and other business-specific details.
Poinky makes reasonable efforts to create accurate content, but you know your business best and are responsible for approving business-specific information before launch.
Poinky may use modern technology-assisted tools in its design, development, content creation, research, optimization, and production processes. Poinky remains responsible for delivering the website service you purchased.
Some website functionality may rely on third-party services such as domain registrars, hosting providers, Google, Stripe, email providers, analytics platforms, plugins, APIs, or social platforms. These services may have their own terms, pricing, availability, and technical limitations.
Poinky cannot guarantee uninterrupted operation of third-party systems outside Poinky's control. This does not diminish Poinky's responsibility for its own work.
If Poinky purchases a third-party product specifically for your project that cannot be refunded (such as a domain registration, premium license, or paid plugin), that cost may be excluded from your refund where applicable. Poinky will not purchase optional third-party products without your approval unless they are clearly included in your purchased package.
All website packages include 12 months of Poinky SiteCare, which includes managed hosting, security monitoring, performance optimization, and unlimited routine website updates (text changes, image swaps, business hours, contact information, service updates, and similar routine content changes).
Unlimited routine updates do not include new pages, major redesigns, custom functionality, new integrations, major structural changes, or significant expansion of the website. Work outside the scope of routine updates may require an additional fee — Poinky will always get your approval before any additional charges.
SiteCare subscription cancellation is separate from website project cancellation. After any included SiteCare period, customers on a paid SiteCare subscription may cancel to prevent future renewal charges.
Any work outside the purchased package scope must be discussed with and approved by you before Poinky performs it. You will never receive a surprise charge. This includes additional pages, new custom functionality, major redesigns, new integrations, and substantial expansion of the website.
Upon full payment and completion of the website project, you receive ownership of the final, approved, launched website as delivered. This includes the custom design, content created specifically for your project, and the website as a whole.
Poinky may retain rights to reusable code, frameworks, tools, and processes used across multiple projects. If a project is canceled and refunded, ownership of unfinished work is governed by the Poinky Satisfaction Promise.
Poinky may update these Terms of Service periodically. The version in effect at the time of your purchase applies to your order. Material changes will be posted on the Poinky website.
